What is Mediation?

Mediation is a peaceful and structured process for resolving disputes between parties with the assistance of a neutral third party – the mediator. It may be applied in civil, family, labor disputes, and, in certain cases defined by law, in other legal contexts. Mediation can be conducted directly by a mediator or through a permanent mediation institution.

  • Who is a Mediator?

A mediator is an independent and impartial individual with no interest in the outcome of the dispute. Their role is to assist the parties in reaching a mutually acceptable resolution. Mediators may operate independently or within a mediation institution.

  • Who is a Licensed (Accredited) Mediator?

A licensed mediator is a qualified professional who meets the legal requirements and is registered in the official mediator registry. To be eligible, an individual must be at least 25 years old and possess a university degree.

Mediation is characterized by its key principles: voluntariness, cooperation, flexibility, confidentiality, speed, and cost-efficiency. It is suitable for resolving a wide range of disputes, regardless of their complexity.

What is Mediation Confidentiality?

The mediator is legally bound to maintain confidentiality. This obligation covers all information disclosed during the mediation process, including its nature and content. Confidentiality may only be waived in cases specifically provided by law.

How is Mediation Conducted?

Mediation is carried out with the mutual consent of the parties, in a manner they agree upon-unless otherwise stipulated by law. In the absence of such agreement, the procedure follows the rules of the mediator’s self-regulatory organization or the internal regulations of a permanent mediation institution.
Mediation is a non-litigious method of dispute resolution. With the help of a neutral mediator, parties work together to find a mutually acceptable solution outside the courtroom.

What Types of Disputes Can Be Resolved Through Mediation?

  • Family Disputes

  • Labor Disputes

Workplace conflicts-such as unpaid wages, denied leave, wrongful termination, or inadequate performance evaluations-are well-suited for mediation. It is widely considered the most effective method for resolving employment disputes.

  • Business Disputes Between Partners

When is Mediation Mandatory Before Court Proceedings?

Recent legislation in Armenia requires mandatory mediation for specific family law disputes before initiating a court case. These include:

  • Divorce

    1
  • Determining the child’s place of residence

    2
  • Child support (alimony) claims

    3
